Many data processing operations are only possible with your express consent. You can withdraw consent you have already given at any time. The lawfulness of the data processing carried out up to the withdrawal remains unaffected by the withdrawal.

This right of complaint is without prejudice to other administrative or judicial remedies.

Right to data portability

You have the right to have data that we process automatically on the basis of your consent or in performance of a contract handed over to you or to a third party in a common, machine-readable format. If you request the direct transfer of the data to another controller, this will only take place insofar as it is technically feasible.

SSL and TLS encryption

For security reasons and to protect the transmission of confidential content, such as orders or enquiries that you send to us as the site operator, this site uses SSL or TLS encryption. You can recognise an encrypted connection by the fact that the address bar of the browser changes from “http://” to “https://” and by the padlock symbol in your browser bar.

When SSL or TLS encryption is activated, the data you transmit to us cannot be read by third parties.

Encrypted payment transactions on this website

If, after concluding a contract for which a charge is made, there is an obligation to send us your payment data (e.g. account number for a direct debit mandate), this data is required for payment processing.

Payment transactions using the usual means of payment (Visa/MasterCard, direct debit) are carried out exclusively via an encrypted SSL or TLS connection. You can recognise an encrypted connection by the fact that the address bar of the browser changes from “http://” to “https://” and by the padlock symbol in your browser bar.

With encrypted communication, the payment data you transmit to us cannot be read by third parties.

Information, deletion and correction

Within the framework of the applicable statutory provisions, you have the right at any time to free information about your stored personal data, its origin and recipients and the purpose of the data processing and, where applicable, a right to the correction or deletion of this data. You can contact us at any time about this and about any other questions on the subject of personal data.

Right to restriction of processing

You have the right to request the restriction of the processing of your personal data. You can contact us about this at any time. The right to restriction of processing exists in the following cases:

  • If you dispute the accuracy of the personal data we have stored about you, we usually need time to check this. For the duration of the check you have the right to request the restriction of the processing of your personal data.
  • If the processing of your personal data happened or is happening unlawfully, you can request the restriction of the data processing instead of deletion.
  • If we no longer need your personal data but you need it to exercise, defend or assert legal claims, you have the right to request the restriction of the processing of your personal data instead of deletion.
  • If you have lodged an objection under Art. 21(1) GDPR, a balance must be struck between your interests and ours. As long as it has not been determined whose interests prevail, you have the right to request the restriction of the processing of your personal data.

If you have restricted the processing of your personal data, this data may – apart from being stored – only be processed with your consent or to assert, exercise or defend legal claims, or to protect the rights of another natural or legal person, or for reasons of important public interest of the European Union or a member state.

Objection to advertising emails

The use of contact data published within the framework of the imprint obligation to send advertising and information material that has not been expressly requested is hereby objected to. The operators of these pages expressly reserve the right to take legal action in the event of the unsolicited sending of advertising information, for example by spam emails.

4. Data collection on this website

Cookies

Our web pages use what are known as “cookies”. Cookies are small text files and do not cause any damage to your device. They are stored on your device either temporarily for the duration of a session (session cookies) or permanently (permanent cookies). Session cookies are deleted automatically at the end of your visit. Permanent cookies remain stored on your device until you delete them yourself or your web browser deletes them automatically.

Cookies from third-party companies may also be stored on your device when you enter our site (third-party cookies). These enable us or you to use certain services of the third-party company (e.g. cookies for processing payment services).

Cookies have various functions. Many cookies are technically necessary because certain website functions would not work without them (e.g. the shopping basket function or the display of videos). Other cookies serve to evaluate user behaviour or to display advertising.

Cookies that are required to carry out the electronic communication process, to provide certain functions you have requested (e.g. for the shopping basket function) or to optimise the website (e.g. cookies for measuring the web audience) (necessary cookies) are stored on the basis of Art. 6(1)(f) GDPR, unless another legal basis is stated. The website operator has a legitimate interest in storing necessary cookies for the technically error-free and optimised provision of its services. Where consent to the storage of cookies and comparable recognition technologies has been requested, processing is carried out exclusively on the basis of this consent (Art. 6(1)(a) GDPR and Section 25(1) TTDSG); consent can be withdrawn at any time.

You can set your browser so that you are informed when cookies are set and only allow cookies in individual cases, exclude the acceptance of cookies for certain cases or in general, and activate the automatic deletion of cookies when the browser is closed. If cookies are deactivated, the functionality of this website may be limited.

Insofar as cookies are used by third-party companies or for analysis purposes, we will inform you about this separately within the framework of this privacy policy and, where applicable, request your consent.

Server log files

The provider of these pages automatically collects and stores information in what are known as server log files, which your browser transmits to us automatically. These are:

  • browser type and browser version
  • operating system used
  • referrer URL
  • host name of the accessing computer
  • time of the server request
  • IP address

This data is not merged with other data sources.

This data is collected on the basis of Art. 6(1)(f) GDPR. The website operator has a legitimate interest in the technically error-free presentation and the optimisation of its website – the server log files must be recorded for this purpose.

Contact form

If you send us enquiries via the contact form, your details from the enquiry form, including the contact data you provide there, will be stored by us for the purpose of processing the enquiry and in case of follow-up questions. We do not pass on this data without your consent.

This data is processed on the basis of Art. 6(1)(b) GDPR if your enquiry is connected with the performance of a contract or is necessary for the implementation of pre-contractual measures. In all other cases, the processing is based on our legitimate interest in the effective handling of the enquiries addressed to us (Art. 6(1)(f) GDPR) or on your consent (Art. 6(1)(a) GDPR) if this has been requested; consent can be withdrawn at any time.

The data you enter in the contact form will remain with us until you ask us to delete it, withdraw your consent to its storage, or the purpose for storing the data no longer applies (e.g. once your enquiry has been dealt with). Mandatory statutory provisions – in particular retention periods – remain unaffected.

Enquiries by email, telephone or fax

If you contact us by email, telephone or fax, your enquiry including all personal data arising from it (name, enquiry) will be stored and processed by us for the purpose of dealing with your request.

The data you send us with contact enquiries will remain with us until you ask us to delete it, withdraw your consent to its storage, or the purpose for storing the data no longer applies (e.g. once your request has been dealt with). Mandatory statutory provisions – in particular statutory retention periods – remain unaffected.

Registration on this website

You can register on this website in order to use additional functions on the site. We use the data entered for this purpose only for the purpose of using the respective offer or service for which you have registered. The mandatory details requested during registration must be provided in full. Otherwise we will refuse the registration.

For important changes, for example to the scope of the offer or for technically necessary changes, we use the email address provided during registration to inform you in this way.

The data entered during registration is processed for the purpose of carrying out the user relationship established by the registration and, where applicable, for initiating further contracts (Art. 6(1)(b) GDPR).

The data collected during registration is stored by us for as long as you are registered on this website and is deleted thereafter. Statutory retention periods remain unaffected.

5. Plug-ins and tools

Font Awesome (local hosting)

For the uniform display of typefaces, this site uses Font Awesome. Font Awesome is installed locally. No connection to servers of Fonticons, Inc. takes place in the process.

You can find further information about Font Awesome in the Font Awesome privacy policy at: https://fontawesome.com/privacy.

6. eCommerce and payment providers

Processing of data (customer and contract data)

We collect, process and use personal data only insofar as it is necessary for the establishment, the arrangement of the content or the amendment of the legal relationship (inventory data). This is done on the basis of Art. 6(1)(b) GDPR, which permits the processing of data for the performance of a contract or pre-contractual measures. We collect, process and use personal data about the use of this website (usage data) only insofar as this is necessary to enable the user to use the service or to bill for it.

The customer data collected is deleted after completion of the order or termination of the business relationship. Statutory retention periods remain unaffected.

Transfer of data when concluding a contract for services and digital content

We transfer personal data to third parties only if this is necessary within the framework of the contract processing, for example to the credit institution commissioned to process the payment.

The data is not transferred any further, or only if you have expressly consented to the transfer. Your data is not passed on to third parties without your express consent, for example for advertising purposes.

The basis for the data processing is Art. 6(1)(b) GDPR, which permits the processing of data for the performance of a contract or pre-contractual measures.

Payment services

We integrate payment services from third-party companies on our website. When you make a purchase from us, your payment data (e.g. name, payment amount, bank details, credit card number) is processed by the payment service provider for the purpose of payment processing. The respective contractual and data protection provisions of the respective providers apply to these transactions. The payment service providers are used on the basis of Art. 6(1)(b) GDPR (contract processing) and in the interest of a payment process that is as smooth, convenient and secure as possible (Art. 6(1)(f) GDPR). Insofar as your consent is requested for certain actions, Art. 6(1)(a) GDPR is the legal basis for the data processing; consent can be withdrawn at any time with effect for the future.

We use the following payment services / payment service providers within the framework of this website:

PayPal

The provider of this payment service is PayPal (Europe) S.à.r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg (hereinafter “PayPal”).

The transfer of data to the USA is based on the standard contractual clauses of the EU Commission. You can find details here: https://www.paypal.com/en/webapps/mpp/ua/pocpsa-full.

For details please see PayPal’s privacy policy: https://www.paypal.com/en/webapps/mpp/ua/privacy-full.

7. Use of artificial intelligence when handling your enquiries

We use an AI-supported system to handle customer enquiries. This applies to the following ways in which you can reach us:

Email

Incoming emails to our customer mailboxes are read by an AI system, classified by subject and pre-sorted. For some of the enquiries, the system prepares a draft reply. The data processed in this context are the details you write to us yourself – typically your name, email address, booking number, vehicle registration number, travel period and the content of your message.

WhatsApp

If you write to us via WhatsApp, your message is read by an AI-supported assistant and, as a rule, answered automatically. You are informed of this fact in the reply itself. The data processed are your mobile phone number, the display name you have chosen and the content of your message as well as – if you ask about it – details of your booking.

Purpose and legal basis

The purpose is to deal with your request and to perform the parking contract. The legal basis is Article 6(1)(b) GDPR in so far as the processing is necessary for the performance of a contract with you or in order to take steps at your request prior to entering into a contract, and otherwise our legitimate interest in handling enquiries promptly and consistently pursuant to Article 6(1)(f) GDPR.

Recipients and transfer to the USA

For the operation of the AI system, the data referred to above are transferred to Anthropic PBC, 548 Market Street, PMB 90375, San Francisco, CA 94104, USA. That company acts as a processor on our behalf. A data processing agreement pursuant to Article 28 GDPR has been concluded with Anthropic.

The processing also takes place outside the European Union. It is based on the European Commission's standard contractual clauses (Module Two, controller to processor) pursuant to Implementing Decision (EU) 2021/914 of 4 June 2021, which form part of the data processing agreement.

Your data do not train any AI models

Anthropic is contractually prohibited from using the content transferred by us to train its models.

No automated individual decision-making concerning your rights

No decision based solely on automated processing within the meaning of Article 22 GDPR which produces legal effects concerning you or similarly significantly affects you takes place. Decisions with financial implications – for example on refunds, credit notes, cancellations or cases of damage – are taken exclusively by a member of our staff. If the assistant creates a booking for you via WhatsApp at your express request, this is done on your own initiative.

Storage period

Your enquiry and the related correspondence remain stored with us until your request has been dealt with conclusively and no statutory retention periods stand in the way of deletion.

Your right to object

You may object to the handling of your enquiry by the AI system at any time and request that a member of our staff attend to your request personally. A short message to us is sufficient; you will suffer no disadvantage as a result.

8. Embedded services

When this website is opened, content from other providers is loaded. In this process your IP address is transmitted to those providers, so that the content can reach you at all. Which providers these are and what happens in each case is set out here.

Booking window (ParkStar)

The booking window on this website does not come from us; it is provided by a service provider and loaded as an embedded window: Morendo IT GmbH, Chemnitzer Straße 20, 15732 Schulzendorf (“ParkStar”). It loads automatically as soon as you open the page – even if you do not wish to make a booking at all.

As soon as the page is opened, your IP address is transmitted to the service provider’s server, and a cookie named parkstar_session is set. It serves to hold your entries together during the booking process and expires after two hours.

If you enter data in the booking window, it is processed there – name, address, telephone number, e-mail address, vehicle registration number, travel period and the payment details. The legal basis is Art. 6(1)(b) GDPR, because the booking is not possible without this processing; for the mere loading of the window we rely on our legitimate interest in a functioning booking facility pursuant to Art. 6(1)(f) GDPR.

Google tag, Google Ads and Google Analytics

Each time it is opened, this website loads a tag of Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. Two services run through it: measuring the success of our advertisements (Google Ads) and measuring reach (Google Analytics 4). In this process your IP address, the address called up, the browser type and the page you came from are transmitted.

Without your consent, no cookies are set in this process and no identifiers are stored on your device. We have configured Google’s consent mode in such a way that storing and reading on your device are refused from the outset. Google therefore receives only a message without a cookie, from which no recognisable profile of your visits can be formed. You can verify this by the marker gcs=G100 in the request to Google.

The legal basis for the transmission itself is our legitimate interest in being able to assess the success of our advertisements and the use of our website, Art. 6(1)(f) GDPR. You may object to this at any time; a brief message to us is sufficient.

Google also processes data in the United States. Google provides further information in its privacy policy at https://policies.google.com/privacy.

Fonts and images from other providers

The fonts of this website are loaded from Bunny Fonts (fonts.bunny.net), and some of the photos from Unsplash (images.unsplash.com). Both are services outside our own website.

So that the fonts and the images reach you, your IP address is transmitted to these providers in the process. They do not set any cookies.

The legal basis is our legitimate interest in a consistent and fast-loading presentation of the website, Art. 6(1)(f) GDPR.

9. SMS notifications

If you give us your mobile number when making a booking, we use it to notify you about your parking – for example about the pick-up on your return journey or about a change of your parking space. The legal basis is Art. 6(1)(b) GDPR, the performance of the contract concluded with you.

For sending these messages we use sipgate GmbH, Gladbacher Str. 74, Düsseldorf, Germany, as a processor. A data processing agreement pursuant to Art. 28 GDPR is in place with sipgate. Only your mobile number and the text of the message are transmitted.

If you do not wish to receive text messages from us, a short message to us is enough. We will then notify you by another route.

Guaranteed no key handover
